Can You Switch Without Leaving the UK?

One of the most common questions we get is whether you can change your visa type without flying home first. The answer depends entirely on what visa you currently hold.

Visas That Allow Switching

If you are on any of the following, you can switch to a Skilled Worker visa (or most other work routes) while staying in the UK:

For these switches, your employer assigns an Undefined Certificate of Sponsorship and you apply from within the UK.

Visas That Do NOT Allow Switching

Some visa types require you to leave the UK and apply from your home country:

If you are on a Visitor visa and someone offers you a job, you must leave the UK, get a CoS, and apply for a Skilled Worker visa from abroad with a Defined CoS.

The Switching Process

Here is how an in-country switch typically works:

  1. Get a job offer from a licensed sponsor. Make sure the company holds an active, A-rated sponsor licence.
  1. Employer assigns an Undefined CoS. This is done through the Home Office's Sponsorship Management System.
  1. Submit your visa application online. You apply via the UK Visas and Immigration (UKVI) website.
  1. Attend a biometrics appointment. Unless you can reuse previous biometrics (this is becoming more common from April 2026).
  1. Wait for a decision. Standard processing takes up to 8 weeks. Priority is 5 working days. Super Priority is the next working day.
  1. Start your new job. Once approved, you can begin working for your new sponsor immediately.

Important Things to Know About Switching

Your old visa ends when the new one starts

Once your new visa is granted, your previous visa is cancelled. There is no going back to the old one.

You can work while waiting

If you submitted a valid in-time application (before your current visa expired), you have something called Section 3C leave. This lets you continue working under the conditions of your old visa while waiting for the decision. However, you cannot travel and re-enter the UK during this period.

Time on previous visas may not count

Here is where it gets complicated. The government is changing the rules on how time across different visa categories counts towards settlement. The 10-year long residence route is being abolished. Time on a Student or Graduate visa will not count towards the 5-year (soon to be 10-year) qualifying period for Indefinite Leave to Remain on the Skilled Worker route.

You must still meet all the requirements

Switching does not give you any shortcuts. You need to meet the same salary threshold (£41,700), English requirement (B2), and skill level (RQF 6) as someone applying from abroad.

Fees are slightly different

In-country applications generally have different fee structures compared to out-of-country ones. In some cases, they are cheaper. In others (like spouse visas from April 2026), they are actually more expensive.

Graduate to Skilled Worker: The Most Common Switch

The most popular switch is from Graduate visa to Skilled Worker visa. Here is the timeline that works best:

  1. Start job hunting 3 to 6 months before your Graduate visa expires
  2. Secure a role with a licensed sponsor
  3. Employer assigns CoS
  4. Apply for Skilled Worker visa (pay priority if your Graduate visa is expiring soon)
  5. New visa granted, you keep working without any gap

The key mistake people make is waiting too long. If your Graduate visa expires before you submit the Skilled Worker application, you lose the right to switch and must leave the UK.

What If Your Current Visa Is Expiring Soon?

If you have less than 28 days left, move fast. Ask your employer to prioritise the CoS assignment and consider Super Priority processing (£1,000, decision next working day). Do not let your visa expire before submitting the new application.

If your visa has already expired, you generally cannot switch in-country. Seek legal advice immediately.
